What Is Not Covered by Medical Malpractice Insurance?

Medical liability insurance typically does not cover claims of illegal acts or sexual misconduct. Also, a policy may be voided entirely if a physician materially misrepresents factual information when applying for a policy.  Finally, medical malpractice insurance does not cover general liability claims (eg, slip and fall, theft of equipment, libel or slander, etc).

1. Occurrence policies. This type of policy will cover malpractice claims for events that occurred while the policy was in force.


2. Claims made policies. This policy will cover malpractice claims made while the policy is in force.  (It does not matter when the event occurred.)


3. Tail coverage.  A policy that should be purchased if coverage is canceled for a current claims-made policy, to avoid a gap in coverage. This is a policy that covers a provider if a claim is made for the work done under a prior insurance policy. If the client wishes to purchase a tail from another carrier, it is called a Stand Alone Tail.
